1. Scope and contracting party

These Terms and Conditions apply to all bookings of the AEROTRX valet parking service. The contracting party is Halit Koyunoglu, trading under the business name AEROTRX.

For each individual order, expressly negotiated agreements take precedence, followed by the booking confirmation and then these Terms and Conditions. To ensure clear documentation, individual agreements should be confirmed in text form; their statutory precedence remains unaffected.

Any differing terms of a business customer apply only if AEROTRX expressly agrees to them in text form.

2. Scope of service

The AEROTRX valet parking service specialises in BMW and MINI vehicles and is offered exclusively for confirmed BMW and MINI vehicles. AEROTRX is an independent provider and is not a company of BMW AG or MINI.

AEROTRX accepts the vehicle at the confirmed meeting point, documents its visible condition, drives it to the designated parking area, keeps it there during the booked period and returns it to the meeting point after a proper return request.

The scope stated in the booking confirmation applies. A particular outdoor area, underground garage, parking level or individual parking space is owed only if expressly confirmed. For operational or safety reasons, AEROTRX may relocate the vehicle within a parking category of at least equivalent quality.

AEROTRX may use its own employees as well as carefully selected drivers, parking operators and other agents. AEROTRX’s statutory responsibility remains unaffected. AEROTRX operates independently of the airport operator.

3. Booking and formation of the contract

A booking request does not yet constitute acceptance. The contract is formed only when AEROTRX confirms the order by email or another durable medium.

Before confirmation, AEROTRX may reject a request, in particular due to insufficient capacity, an unsuitable vehicle or incomplete information.

The customer must provide the correct mobile number, email address, registration number, vehicle details, handover and return times and complete flight numbers. Changes and apparent input errors must be reported without delay. The customer bears disadvantages and necessary additional costs caused by culpably incorrect or late information in accordance with statutory provisions.

4. Price, additional services and payment

The total price stated in the booking confirmation applies. Additional services or costs will be charged only if agreed or culpably caused by the customer and if they are actually necessary and verifiable.

The method and due date of payment are stated in the booking confirmation. AEROTRX may require an appropriate advance payment. Statutory consequences of default apply to amounts that are due.

Price changes are permitted only if the customer changes the order after the contract is formed, for example by extending the parking period, booking an additional service or handing over an oversized vehicle that was not previously disclosed.

AEROTRX’s statutory rights of retention in respect of amounts due under the same order remain unaffected. This does not apply where the customer validly sets off a claim or exercises a statutory right of retention.

5. Authorisation, insurance and vehicle condition

The customer must be the owner of the vehicle or be validly authorised to book and hand it over. If a third party hands over or collects the vehicle, AEROTRX may request written authority and an official photo ID.

The vehicle must be registered, roadworthy, operationally safe and covered by motor liability insurance. The insurance cover must permit the necessary journeys by the drivers used by AEROTRX. Restrictions on authorised drivers, age limits or other insurance conditions must be disclosed before the contract is formed.

The vehicle must have sufficient fuel or charge. Unless separately booked, AEROTRX is not required to refuel or recharge it. The customer bears necessary assistance, towing or standing costs caused by a pre-existing defect or insufficient energy if the customer knew of the circumstance or culpably failed to disclose it.

Known defects, warning messages, special starting or operating procedures, immobilisers, modifications, lowered suspension, unusual dimensions or weights and sensitive special equipment must be disclosed in full before handover.

6. Arrival and vehicle handover at the airport

The customer starts navigation in the AEROTRX app in good time before vehicle acceptance. With the customer’s consent, the app automatically shares and updates the current navigation ETA. A call is required only if no digital confirmation appears, transmission is disrupted, the arrival time changes significantly or a specific problem occurs. In that event, the customer contacts AEROTRX without delay and provides the current navigation ETA.

The meeting point is generally DEPARTURES · TERMINAL 1 · GATE B6 at Frankfurt Airport. In the event of a closure, altered traffic routing, official order or security situation, AEROTRX may specify a reasonable alternative meeting point.

The customer must arrive punctually at the confirmed time and remain reachable by telephone. If the most recently reported navigation arrival time cannot be met, the customer must inform AEROTRX of the new time as early as possible. The customer must not arrive substantially earlier or later without coordinating this with AEROTRX. Every minute counts during vehicle turnover.

The customer remains responsible for allowing sufficient time for check-in, security checks and departure. AEROTRX does not provide passenger transport and does not guarantee a successful journey or flight departure.

7. Handover record and evidence photographs

When accepting the vehicle, AEROTRX documents in particular its externally visible condition, evidence photographs, mileage, visible pre-existing damage, fuel or battery level, warning messages and the handover of the key.

The customer cooperates in ensuring prompt documentation and digitally confirms the actual handover. The record and photographs serve as evidence for both parties; statutory rights and the statutory burden of proof are not altered.

Dirt, moisture, darkness, restricted traffic conditions or inaccessible areas of the vehicle may limit the visibility of pre-existing damage. The documentation does not constitute acknowledgement that the vehicle is free from other pre-existing damage or technical defects.

8. Permitted journeys, parking area and key

The customer authorises all journeys necessary for the order between the meeting point, transfer area, final parking area and return meeting point. Necessary manoeuvring, relocation, refuelling, charging, checking and a short functional test drive are also permitted where required for safe performance or separately agreed. Any private use is prohibited.

Necessary journeys may change the mileage and fuel or battery level slightly. The values documented at acceptance and return are decisive.

The key is assigned to the internal order and stored securely. Parking-space, key and internal driver information is not displayed publicly for security reasons.

Where an outdoor parking space is booked, there is no protection from normal weather and environmental effects such as rain, dust, pollen or bird droppings. AEROTRX remains responsible for culpably caused damage in accordance with section 14.

9. Return request using “I’M COMING”

After landing, the customer checks that they can be reached and informs AEROTRX of any changes. Only after baggage reclaim and, where applicable, passport control have been completed and the customer is able to walk to the meeting point does the customer press the yellow “I’M COMING” status in the app. If no digital confirmation appears or transmission is technically unavailable, the customer contacts AEROTRX by telephone.

Only this notification starts the final preparation of the vehicle for return. Automatic flight, baggage or location data is used only as a planning aid and does not replace the customer’s notification.

The customer must not activate “I’M COMING” as a precaution or substantially too early. After the notification, the customer must proceed to the meeting point without avoidable delay and remain reachable. If the subsequently agreed or confirmed time cannot be met, AEROTRX must be informed immediately. Additional costs are governed by section 10.

The vehicle is generally returned at DEPARTURES · TERMINAL 1 · GATE B6 or at the notified alternative meeting point. AEROTRX may verify the person’s authority to collect before releasing the vehicle.

10. Availability, changes and delays

The customer must remain reachable on the stated mobile number around the times of handover and return. Flight changes, delays, rebookings, baggage problems, changes to the return date and early returns must be reported without delay.

Arrival and preparation times are planning estimates unless AEROTRX has expressly confirmed a binding time. Traffic, airport closures, security checks, official measures, extreme weather, flight changes and other events beyond AEROTRX’s control may cause delays.

If the customer fails to report a foreseeable change to the last reported or confirmed navigation arrival time for vehicle handover without delay, or fails to appear at the agreed meeting point without avoidable delay after activating “I’M COMING” for vehicle return, AEROTRX may charge the coordination and waiting fee of EUR 20.00 clearly stated at the time of booking once for each affected handover or return procedure. This requires driver waiting time, rescheduling or an additional journey to have arisen. The same applies if the customer activates “I’M COMING” although baggage reclaim or, where applicable, passport control has not yet been completed or the customer is not yet able to walk to the meeting point.

The fee does not apply if the customer informs AEROTRX of the changed time in good time and no additional waiting or coordination service arises. The customer may prove that no loss or a substantially lower loss occurred. The same procedure will not be charged twice.

If the fee was not clearly agreed before the contract was formed, AEROTRX may claim only necessary and verifiable additional costs.

11. Extension and late collection

An extension becomes effective only after confirmation by AEROTRX. Unless otherwise stated in the booking confirmation, each additional calendar day or part thereof costs EUR 20.00.

If the vehicle is not collected after the booked period has ended and the customer cannot be reached, AEROTRX may return it to or relocate it to a suitable parking area. The customer bears the necessary, reasonable and verifiable additional costs to the extent that the customer is responsible for the late collection.

After unsuccessful attempts to make contact and the expiry of a reasonable deadline, AEROTRX may take legally permissible measures for the continued storage or removal of the vehicle. Further statutory claims remain unaffected.

12. Cancellation, no-show and right of withdrawal

The customer may cancel before handing over the vehicle using the designated booking function or in text form. Cancellation is free of charge only if this was expressly promised in the booked rate or if a statutory right of withdrawal is validly exercised.

For any other cancellation or no-show, AEROTRX may claim the loss actually incurred up to the amount of the agreed price. Expenses saved and any possible alternative booking will be credited. The customer may prove that no loss or a lower loss occurred.

Consumers generally have a statutory right of withdrawal for online or telephone bookings unless a statutory exception applies. Before an actual booking is completed, AEROTRX provides a separate withdrawal notice and a model withdrawal form for this purpose.

If, at the consumer’s express request, AEROTRX is to begin during the withdrawal period, statutory compensation for the service performed up to the time of withdrawal may become payable. Once the service has been fully performed, the right of withdrawal expires only under the statutory conditions and after the consumer has provided the corresponding confirmation.

13. Refusal, suspension and force majeure

AEROTRX may refuse to accept the vehicle or suspend the service if there is an important or objectively justified reason. This applies in particular where there is no authority to hand over the vehicle, no insurance cover, the vehicle is not roadworthy, materially incorrect information has been provided, dangerous objects are present, aggressive behaviour occurs or there is a specific danger to people, vehicles or operations.

If an event for which neither party is responsible temporarily prevents or alters performance, both parties will agree on a reasonable alternative solution. Statutory rights in the event of impossibility or disruption of the basis of the transaction remain unaffected.

Where AEROTRX lawfully terminates a confirmed order for a reason attributable to the customer, AEROTRX may charge for services already performed and necessary, verifiable costs. Any payments received beyond this will be refunded without delay.

14. Liability of AEROTRX

AEROTRX has unlimited liability for intent and gross negligence and for culpably caused injury to life, body or health. Any mandatory statutory liability remains unaffected.

In the event of ordinary negligence, AEROTRX is liable only for breach of a material contractual obligation. In this case, liability is limited to the foreseeable loss typical for the contract at the time it was formed. These limitations also apply in favour of AEROTRX’s legal representatives and agents.

AEROTRX is not liable to the extent that loss or damage results from a pre-existing defect, normal wear and tear, ordinary depreciation, a technical defect not caused by AEROTRX or a circumstance concealed by the customer.

AEROTRX is liable for missed flights, hotel, taxi, hire-car, loss-of-use or other consequential costs only to the extent that they are recoverable under the above rules, were foreseeable when the contract was formed and are attributable to AEROTRX. The customer must take reasonable measures to mitigate loss.

15. Customer responsibility and third-party claims

Under statutory provisions, the customer is liable for damage and necessary costs caused by culpably incorrect information, lack of authority, an unsuitable vehicle, undisclosed insurance restrictions or prohibited objects.

If third parties make claims against AEROTRX due to such a circumstance attributable to the customer, the customer reimburses AEROTRX for justified and documented costs. AEROTRX will inform the customer without delay and enable the customer to raise valid objections.

16. Items, cameras and remote access

Cash, jewellery, important documents, data carriers and other particularly valuable items must be removed from the vehicle before handover. AEROTRX does not assume any special duty of safekeeping for items that have not been disclosed.

Weapons, hazardous substances, animals, perishable goods, illegal objects and items that may endanger people or vehicles must not remain in the vehicle.

Active interior cameras or dashcams that record drivers or employees must be disclosed before handover and generally deactivated. During the storage period, the customer must refrain from unannounced remote commands such as locking, activating the alarm or installing software updates if this could interfere with the order. Necessary interventions must be coordinated with AEROTRX in advance.

17. Data, app and technical information

AEROTRX processes the data required for booking, handover, parking, return, security and billing. This may include vehicle, flight, location and communication data, photographs and digital confirmations. Details are provided in the Privacy Policy.

App, flight and navigation data may be technically delayed, incomplete or temporarily unavailable. In the event of an apparent disruption, the customer must use the stated telephone number. AEROTRX maintains appropriate backup procedures for essential operational steps.

Parking-space, key and internal driver information is security-related data and is not displayed publicly. Customers receive only the information intended for their own order.

18. Complaints, governing law and jurisdiction

Questions, complaints and damage reports may be sent to info@aerotrx.de or +49 176 4797 6655. To enable prompt review, the booking number, registration number, time and any available photographs should be provided. This does not shorten any statutory time limits.

AEROTRX is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.

German law applies. Consumers retain the protection of mandatory provisions of the country of their habitual residence and the statutory places of jurisdiction.

If the customer is a merchant, a legal entity under public law or a special fund under public law, Frankfurt am Main is the exclusive place of jurisdiction to the extent permitted by law.

If an individual provision is invalid, the statutory provisions apply in its place. The validity of the remaining provisions remains unaffected.

19. ATM site development (B2B)

AEROTRX ATM site development services are offered exclusively to businesses, legal entities under public law and special funds under public law. AEROTRX identifies, assesses and develops suitable sites and may introduce property providers to professional ATM operators. The nature and scope of each service are governed exclusively by a separate B2B agreement.

Unless expressly agreed in writing, AEROTRX does not guarantee the conclusion of an operator or location agreement, the installation or continued operation of an ATM, or any site approval, permit, level of use, turnover or revenue. Each interested party must provide complete and accurate information regarding the location, ownership or right of use and all other matters relevant to the assessment.

AEROTRX is not the operator of any introduced ATM and is not a bank, payment institution, electronic-money institution or payment service provider. Operation, cash replenishment, technical availability, security, legal and regulatory compliance, data protection, fees, all payment transactions and all claims by ATM users remain the sole responsibility of the operator identified in the relevant contract.

Images of ATMs are used solely as neutral illustrations of site development. They do not represent a particular device specification or an existing cooperation with any specific operator. A partnership or appointment exists only where AEROTRX and the relevant company have expressly confirmed it in text form.

Remuneration, commission, exclusivity, term, location requirements, technical conditions, permits, responsibilities and termination are governed, where applicable, by the relevant B2B agreement. Until that agreement is concluded, each party bears its own assessment and preparation costs unless otherwise agreed.
